طبيعة حكم التحكيم هي أساس نظامه القانوني بما فيه نظام قوته التنفيذية التي هي موضوع الدراسة الراهنة، ولو أن هذه الطبيعة مازالت محل بحث وتردد - ولم يصل الفقه بشأنها إلى يقين كامل. وفي تقديري أن الخلاف حول طبيعة حكم التحكيم، لا يرجع إلى هذه الطبيعة ذاتها، إنما يرجع أساساً إلى اتفاق المناهج المتنازعة حولها على إنكار استقلال حكم التحكيم بصورة أو بأخرى. فمدرسة التحكيم العقدية تنكر استقلال هذا الحكم عن العمل الخاص أو العقدي، لو أنه لا تنكر استقلاله عن العمل القضائي، وذلك خلافاً لمدرسة التحكيم القضائية، بينما مدرسة التحكيم التوفيقية تنكر استقلاله، سواء عن العمل القضائي أو عن العمل الخاص معاً.
ودراسة القوة التنفيذية لحكم التحكيم تثير مسألة تمييز هذه القوة، وبيان مفترضها، وتحليل عناصرها، وبيان حالات وقفها، ثم سبب وأثر انقضائها، وبالتالي فإن هذه الدراسة تتوزع على المباحث التالية:
المبحث الأول: تمييز القوة التنفيذية لحكم التحكيم، المبحث الثاني: مفترض القوة التنفيذية لحكم التحكيم، المبحث الثالث: عناصر القوة التنفيذية لحكم التحكيم، المبحث الرابع: وقف القوة التنفيذية لحكم التحكيم، المبحث الخامس: إنقضاء القوة التنفيذية لحكم التحكيم.
