رغم أهمية المفهوم القانونى للبيئة, سواء بالنسبة لقانون حماية البيئة فى مصر, أو بالنسبة لقوانين حماية البيئة فى مصر العالم أو بالنسبة لنظرية القانون العامة, مضمون قانونى حقيقى, إنما هو نطاق واسع.
فنطاق هذا الاعتقاد, لا يقتصر على الاستاذين الفرنسيين فنسانوجليليان, إنما يشمل أيضا لفيفاص كبيراً من الفقهاء, حتى قيل أن "رجال القانون..اعتادوا التعامل مع البيئة كغيرهم دون إفرادتعريف محددلها..."
يبدأ أن هذا المنهج السائد فى تعريف البيئة فى القانون, لم يعدم من يتعرض علية بصورة أو بأخرى.
إذ اكتفى البعض فى مصر, بمسيرة "الأستاذ Lamarque….. فى قوله: إن كلمة البيئة أحدثت ضجة..... غير أنه يتبغى العمل على حمايتها من التضخم وتحديد أبعادها" وكذلك الأستاذ Ellul فى تسأولة: " ما الذى يمكن أعتباره من مكونات البيئة؟. عند أى حد من التحليل ينبغى التوقف؟".
وذلك على اعتبار أن " التحديد الذى يفدمه علماء البيئة وأنصارها إنما يعبر عن رغبة هؤلاء فى حماية كل ما يحيط بالانسان فى الوسط الذى يعيش فيه, بحيث كان أتساع الفكرة مصدراً لبلبة الباحث القانونى الذى يرغب فى تحديد واضح للبيئة.....".
وقد تخيرت عنوان هذا البحث: "المفهوم القانونى للبيئة فى ضوء مبدأ أسلمة القانون المعاصر" ولو أن فكرة المكتابة لفئة من الباحثين خارج دائرتى المعهود قد أثارت فى نفسى بعض مشاعر الخوف.
لكننى آمل أن يكون التوفيق حليف هذا البحث, بل يراودنى الأمل كذلك فى أن يشجع هذا البحث مواصلة البحث فى مبدأ أسلمة القانون المعاصر.
خطة الدراسة: تتوزع دراسة الموضوع السالف الإشارة إلية: عل ثلاثة مباحث كالتالى:
المبحث الأول: مفهوم البيئة وتطور القانون.
المبحث الثانى: مفهوم البيئة ومفهوم العالم.
المبحث الثالث: أهمية المفهوم القانونى للبيئة.
