كانت القرائن وما تزال تشغل مكاناً فسيحاً في الإثبات, وتشكل إحدى الدعامات الأساسية لوصول القضاء إلى حكم عادل، إذ إن الحصول على الأدلة التي تنصب مباشرة على الواقعة محل البحث قد يكون متعذراً إن لم يكن مستحيلاً في كثير من الأحيان، فالقاضي لا يستطيع دائماً أن يصل إلى الحقائق بصورة مباشرة، فيلجأ إلى تحكيم عقله، باستخدام ضوابط الاستدلال وأصول المنطق للتعرف على أكبر قدرٍ من تلك الحقائق بصورتها المطابقة للحقيقة والواقع.
وقد ازدادت أهمية القرائن في الإثبات في الوقت الحاضـر، بسبب التقدم العلمي والتكنولوجي، حيث ساهمت وسائل التقدم في الكشف عن الكثير من القرائن القضائية، وبالذات العلمية منها، والتي أضحت تشكل الوسيلة الأكثر اعتماداً في القضاء الجزائي في عصرنا الحالي، بخاصة بعد أن لجأ المجرمون إلى استخدام أدق الوسائل، والأساليب العلمية الحديثة, في ارتكاب جرائمهم والعبث في كيان المجتمع دون أن يتركوا آثاراً تدل عليهم. وإدراكاً من الباحث لأهمية القرينة القضائية ودورها في الإثبات الجزائي، قمت بتناول هذا الموضوع، حيث تحتل قواعد الإثبات أهمية بالغة في فروع القانون، فالحق دون دليل يسنده هو كالعدم سواء بسواء، فالدليل هو الذي يدعم الحق ويجعله سائداً، والقرائن تحظى بهذه الأهمية بإعتبارها وسيلة من وسائل الإثبات التي نص عليها المشرع، وأخذ بها القضاء والفقه. إن القرائن القضائية تتعدد، وتتنوع في مجال إثبات الوقائع، وتركزت هذه الدراسة على القانون الأردني، مقارناً بالقانون المصري، واللبناني، وقد قصد الباحث التطرق إلى موضوع القرينة القضائية ودورها في الإثبات الجزائي، نظراً للأهمية التي تُحظى بها القرينة القضائية في ميدان الإثبات الجزائي.
