الشرائع القديمة لم تكن تعترف للفرد بكامل حقوقه السياسية إلا إذا كان يملك مساحة معينة من العقارات، لأن الملكية العقارية كانت بنظرها ثروته الحقيقية، من هنا، أضحت الأعمال التجارية كما والتعاطي بين الأفراد يضمنها ملاءة الفرد أو ثروته أما ما قد حصل على عقارات. لكن تعقيدات التنفيذ على أموال المدين المنقولة أو غير المنقولة راحت تأخذ الوقت الطويل مما يدفعنا بالمطالبة بتبسيط تلك المعاملات، وحتى بتخفيف وطأة الضرائب والرسوم المفروضة على التنفيذ.
ومهما تعددت الكتب التي ناقشت أو فسرت قواعد الحجز التنفيذي فإننا نرى أن مشاكل التنفيذ اليوم إلى ازدياد -وتعقيد في كثير من الأحيان- مما نعيد معه الاقتراح بوجوب إعادة قراءة المواد القانونية العائدة للموضوع وتبسيطها واختصار أمد الحجوزات والمزايدات مما يكفل حقوق الدائنين بشكل عملي وعلمي في آن معاً.
