صدر هذا الكتاب في جزءين: الأول في عام 1922، والثاني في عام 1970. يعتبر شميت أول من استعمل تعبير "اللاهوت السياسي" الذي اشتقّه من تأكيده "إن مفاهيم النظرية الحديثة للدولة كلها ذات الدلالة هي مفاهيم لاهوتية مُعلمَنة"، أي تخاطب النظرية السياسية الدولة بالطريقة نفسها التي يخاطب فيها اللاهوت الله. لذا يبدأ بتعريف سيادة الدولة ويعرض ناقدًا آراء عدد كبير من المفكرين السابقين أو المعاصرين له في مسألة السيادة. كما يتطرق إلى مفهوم السيادة ومفاعيلها في دستور ألمانيا الأول، في عام 1871 بعد توحيدها، ودستورها الثاني في عام 1919 والمعروف بدستور جمهورية فايمار. ثم يحاول أن يثبت العلاقة الوثيقة بين علم اللاهوت وعلم التشريع. ويفنّد الجزء الثاني من الكتاب مقولة "إنهاء اللاهوت السياسي" التي أوردها إيريك بيترسون.
