الدولة ظاهرة قديمة في تاريخ البشرية سواء أكان ذلك على صعيد الواقع أو على صعيد الفكر السياسي. وإذا كانت الدولة ظاهرة تاريخية بمعنى أنها تمتد بجذورها إلى التاريخ القديم فإن الدولة القومية بما تتضمنه من شعب وإقليم محدد وحكومة ذات سيادة إنما هي ظاهرة حديثة نسبياً. إذ ترتبط في ظهورها بالأحداث التي صاحبت انتقال أوروبا من العصور الوسطى إلى العصور الحديثة. وفي السياق القانوني يصبح حق الفلسطينيين في إنشاء دولتهم قائماً على أساسيين قانونيين هما: حق الشعوب في تقرير المصير وقرارات الأمم المتحدة، إذ يعد الحق في تقرير المصير أحد الأسس القانونية- إن لم يكن أهمها بالفعل- التي ينبني عليها حق الفلسطينيين في تحرير أرضهم وتكوين دولتهم المستقلة. والكتاب الذي ألفه الدكتور محمد شوقي عبد العال حافظ يتناول حق الشعب الفلسطيني من منظور الأحكام والقانون الدولي.
يعرض في الباب الأول للأسس القانونية لقيام الدولة الفلسطينية فيتناول في الفصل الأول حق الشعب الفلسطيني في تقرير مصيره وسينقسم الفصل إلى أربعة مباحث يعرض أولها لمضمون حق الشعوب في تقرير مصيرها وطبيعته القانونية، ثم يعرض المبحث الثاني لموضوع العلاقة بين الحكم الذاتي وحق تقرير المصير ويعرض الثالث لتطور موقف الأمم المتحدة من حق الشعب الفلسطيني في تقرير مصيره. وأخيراً يعرض المبحث الرابع للمقاومة الشعبية المسلحة باعتبارها وسيلة لتحقيق أهداف الشعب الفلسطيني.
ويعرض الفصل الثاني لقرارات الأمم المتحدة باعتبارها إحدى الأسس القانونية لقيام الدولة الفلسطينية، ويعرض الفصل الثالث إعلان قيام دولة فلسطين من خلال مبحثين يتناول أولها القيمة القانونية للتصرفات الصادرة بالإرادة المنفردة في القانون الدولي العام ويتناول الثاني القيمة القانونية لإعلان قيام دولة فلسطين. ويتناول الفصل الرابع مبدأ استمرارية الدولة كما تبلور في إطار القانون الدولي العام من خلال مبحثين، الأول يعرض لمبدأ استمرارية الدولة في القانون الدولي العام، والثاني يعرض لمدى انطباق هذا المبدأ على الدولة الفلسطينية. وفي الفصل الخامس يعرض المؤلف لمبدأ الفعالية فيما يتعلق باكتساب السيادة على الإقليم وما طرأ عليه من تطورات في ظل القانون الدولي المعاصر.
