لما كان الاستخدام غير المقنن للطاقة النووية يعرض البشرية لأضرار رهيبة تقودها إلى الدمار الشامل، فقد عقدت اتفاقيات عديدة لتنظيم استخدام هذه الطاقة في الأغراض السلمية. لكن استخدام الطاقة النووية للأغراض العسكرية لم يكن مشمولاً بهذه الاتفاقيات وظلت المشكلات الناتجة عن سباق التسلح النووي قائمة دون حل وقد تكاتفت جهود الساسة والعلماء من شتى المجالات مع جهود كبار القادة العسكريين لوضع مقترحات وحلول تضمن إيقاف هذا السباق المحموم. لكنها ظلت جهوداً ينقصها الشيء الكثير كي تصبح ملزمة لجميع الأطراف فما زال سباق التسلح النووي دائر بجد ولا تزال أخطار انتشاره قائمة.
ورغم أن قانون الحرب القائم يتضمن أحكاماً يمكن تطبيقها في هذا المجال فإن من الأجدر أن يستند الأطراف إلى تلك الأحكام ويجعلوها أساساً يستمدون منها قواعد لتحريم استخدام الأسلحة النووية في الحرب. لكن قانون الحرب وهو جزء من القانون الدولي العام لا يتبع في جميع الظروف فسوف يبقى الوضع كذلك حتى يستقر الوضع الدولي وتتوفر هيئة تشريعية تطوره وتستكمله غير أن عقد معاهدات لتحريم استخدام الأسلحة النووية سوف يترتب عليها آثار سياسية وآثار معنوية وآثار فنية كما إن هذه الاتفاقية ستكون من الناحية القانونية تأكيداً وتطبيقاً لأحكام قائمة تقضي بأن استخدام الأسلحة النووية محرم طبقاً للقانون الدولي القائم. إن هذه الأسئلة والمشاكل المثارة هي ما تشكل مادة هذا الكتاب الذي عكف على تأليفه الدكتور محمود خيري بنونة.
