بمعنى ان لا تكون الإفادة من الطاقة النووية وقوتها الجبارة على حساب تهديد الوجود الإنساني ومحيطة البيئي الذي يعيش فيه؛ ومن هنا، تُثار عدة تساؤلات تطرح بشأن الموضوع نذكر منها: هل تملك الدول كامل الحق في إستخدام الطاقة النووية سلمياً؟ وهل تتحمل الدولة المسؤولية الناجمة عن الضرر النووي الناتج عن تجاربها النووية الخاصة بإستخداماتها السلمية؟ ومدى الحاجة إلى تطوير قواعد المسؤولية الدولية المترتبة على الأضرار النووية بما ينسجم مع الطبيعة الخاصة لهذه الأضرار، وعدم التقيد بالخطأ والعمل غير المشروع كأساس وحيد لقيام المسؤولية الدولية؟... وما هو المعيار المعتمد لتحديد حجم الضرر؟...
وبالتالي، نطاق التعويض ومداه؟ وهل يمكن أن ينتهي الخيار النووي السلمي إلى خيار عسكري؟ علماً أن معظم المفاعلات النووية العسكرية قد بدأت كمشاريع لإنتاج طاقة نووية سلمية؟ وما هي الضمانات والآليات القانونية الكفيلة بعدم تحويل وسائل إستخدام التكنولوجيا والمواد النووية بإتجاه برامج التسلح السرية وغير القانونية مع الحرص على كفالة حق الدول المشروع في إستخدام الطاقة النووية للأغراض السلمية؟...
