هذه رسالة خاصة في "مسألة العمل بالخطوط" لمؤلفها العلامة قاضي القضاة علاء الدين أبي الحسن: علي بن أبي بكر بن إبراهيم، المشهور بابن مفلح، من أحفاد صاحب "الفروع" شمس الدين محمد بن مفلح. تحدث فيها المؤلف في: مسألة الشهادة على الخط، وذلك فيما إذا وجد القاضي كتاباً فيه حكمه لإنسان.
وفي: شهادة الشاهد بناءً على خطه دون أن يتذكر الشهادة. وقد أراد المؤلف بهذه الرسالة أن يثبت أن هذا هو مذهب الإمام أحمد بن حنبل، رداً على من أنكر ذلك، وعرج فيها على ذكر أقوال باقي العلماء -ولا سيما المخالفون وهم الأكثر- مع ما استدلوا به.
فجاءت رسالة لطيفة في موضوعها، مفيدة في بابها، إذ لا يخفى ما ينبني على هذه المسألة من إثبات كثير من الحقوق أو ضياعها. وملحق بآخر هذا المخطوط فتوى تتعلق بالموضوع نفسه، وهي لقاضي القضاة بالديار المصرية: ابن نصر الله الحنبلي.
