جاءت دراستنا لتعالج دراسة أحكام الوضع القانوني القائم بالتشريع المصري في خصوص براءات الإختراع وما يتعلق بها من إجراءات واشتراطات للوصل إلى الحماية المطلوبة للإختراع محل حمايتها، والإلتزامات المترتبة على منحها،وكيفية إستغلالها، وأحكام حمايتها مدنياً وجنائياً، وانتهاء بانقضاء هذه الحماية، ثم نتناول القصور التشريعي في تنظيم أحكام براءات اختراعات العمال بالمنشآت لنقدم اقتراحات على المشرع ليأخذ بها ويطبقها لضرورات تقتضيها ليس فقط مصالح طرفي علاقة العمل بل أيضاً ضرورات المصالح الخاصة بالدولة والتي تعد في مجملها الأولى بالرعاية.
وترتيباً على ما سبق، سوف نقسم هذا البحث إلى فصلين يسبقهما فصل تمهيدي نتناول فيه التنظيم القانوني لبراءات الإختراعات دولياً وداخلياً، لنبحث المدى القانوني لاهتمامات الاتفاقيات الدولية بوضع تنظيم لبراءات الاختراعات وذلك في الاتفاقيات التي تهتم بحماية الملكية الفكرية، ومنها اتفاقية باريس واتفاقية برن واتفاقية التربس، وذلك في مبحث أول، وفي مبحث ثان نتناول التنظيم القانوني لبراءات الاختراعات في القانون الداخلي، وذلك قبل وبعد نفاذ قانون حماية حقوق الملكية الفكرية رقم 82 لسنة 2002، ونتناول في الفصل الأول براءة الاختراع، ونتناول في الفصل الثاني أحكام براءات اختراعات العمال القانونية.
