كنت قد تطرقت إلى نظام الحماية والتعويض، بشكل مختصر جداً، في كتابي "التأمين البحري في التطبيق والتشريع" الصادر سنة 2009 عن دار الثقافة للنشر والتوزيع - عمان، فلم أتوسع في بيان وشرح قواعده، لأنه حسب قناعتي الشخصية، ليس فرعاً من فروع التأمين البحري، حيث لا علاقة له بهيكل السفينة وماكنتها ومعداتها والبضائع المشحونة عليها وأجور الشحن المترتبة لها؛ بل ينحصر نطاقه بتغطية المسؤولية المدنية لمستغلي السفن التجارية وناقلات النفط والناشئة عن نشاطهم في مجال الملاحة البحرية، ومن جهة أخرى لا يمكن إعتباره فرعاً من فروع التأمين من المسؤولية، نظراً لأنه إرتباطه ينحصر بالنشاط الملاحي فقط، ولا علاقة له بالمسؤولية المدنية العامة لمستغلي السفن التجارية.
وعلى هذا، فهو في رأي، نظام خاص قائم بذاته لا علاقة لشركات التأمين التجارية به، بل تختص بتطبيقه جمعيات تبادلية (Mutual Associations) أطلقت عليها تسمية "نوادي الحماية والتعويض - P & I Clubs".
فعلى من يرغب في بحثه أن يبحثه في كتاب مستقل، ولم يكن في نيتي ولا ضمن منهاج عملي أن أولف كتاباً بشرح تفاصيل هذا النظام.
ولعل السبب الذي جعلني أصرف النظر عن تأليف كتاب كهذا، هو عدم وجود نوادٍ للحماية والتعويض (P & I Clubs) في البلاد العربية، مما يجعل هذا الكتاب غير نافع، من الناحية العملية، للعاملين في أسواق التأمين العربية، وينحصر نفعه بشكل محدود بقلة من الآكاديميين وطلبة الدراسات العليا الذين يرغبون في وضع إطروحاتهم في فقرة من فقراته، كمسؤولية الناقل، والمسؤولية المدنية الناشئة عن تلوث البيئة البحرية، وغيرها من الفقرات، ويفترض من هذه القلة من الأكاديميين إجادتهم للغة الإنجليزية مما يغنيهم عن مصدر باللغة العربية.
