Book Description
الحج من العبادات المهمة في الإسلام بل من أركان الدين الحنيف، حيث ورد في الحديث الشريف عن أبي جعفر عليه السلام: قال: "بني الإسلام على خمس: على الصلاة والزكاة والصوم والحج والولاية، وما نودي بشيء كما نودي بالولاية".
وللحج آثار وبركات كبيرة جداً، فهو مصدر قوة الدين وعظمة الإسلام وإتحاد المسلمين، ولهذا نرى التأكيد الكبير عليه من قبل أئمة المسلمين عليهم السلام بحيث أن الإمام أمير المؤمنين في وصيته في الساعات الأخيرة من حياته المباركة يقول مؤكداً: "الله الله في بيت ربكم لا تخلوه ما بقيتم فإنه إن ترك لم تناظروا".
أي ان البلاء الإلهي سيشملكم دون إهمال وقال "فرض الله الإيمان تطهيراً من الشرك... والحج تقوية _ تقربة _ للدين"، وقال الصادق عليه السلام: "لا يزال الدين قائماً ما قامت الكعبة".
ولذا اكتسبت النيابة في الحج هذه الأهمية الكبرى والعظيمة في التشريع الإسلامي، فبحث النيابة لا يقل أهمية عن أصل موضوع الحج، فشريعة الدين الإسلامي تستوعب مجالات الحياة كافة: عبادية، ودنيوية، في علاقة الإنسان بربه وعلاقته بأخيه الإنسان ومن مظاهر هذا الإستيعاب والشمول هو وضع الحالة البديلة لمن عجز عن الحج أو العمرة كلا أو بعضاً والمسماة بالنيابة في الحج أو العمرة ورسم لها تشريعاتها وأحكامها ووضع لكل حالة من حالاتها حكماً مناسباً لها وذلك في ضوء إستيعاب التشريع وسماحته وسهولة كما قال تعالى: ﴿فَأَقِمْ وَجْهَكَ لِلدِّينِ حَنِيفاً فِطْرَةَ اللَّهِ الَّتِي فَطَرَ النَّاسَ عَلَيْهَا لَا تَبْدِيلَ لِخَلْقِ اللَّهِ ذَلِكَ الدِّينُ الْقَيِّمُ وَلَكِنَّ أَكْثَرَ النَّاسِ لَا يَعْلَمُونَ﴾، وكما جاء في الخبر عن النبي صلى الله عليه وسلم "ولكن بعثني بالحنيفية السهلة السمحة".
ولذا فالله تعالى أكرم العباد فجعل من الواجبات ما يقضى بعد وقته، ومنها ما تصح فيه الوكالة، ومنها ماله بدل يقوم مقامه، وبعضها يسقط بالعجز عن الإتيان به؛ ومن هذه الأحكام التي جاءت مخرجاً للعباد وتسهيلاً لهم النيابة في الحج وقد تعرض الفقهاء إلى هذا الموضوع وأبرزوا أهميته في الفقه الإسلامي أحكامه وتفريعاته والعلاجات المناسبة لكل حالة من حالاته من قبيل أصل مشروعية النيابة في الحج، أو العمرة ومشروط النائب والمنوب عنه، ووضع العلاج لحالات مخالفات النائب، وسوف تقوم بدراسة وبحث هذا الموضوع بكل ما يرتبط به من أحكام وشرائط وفق المذهب الأمامي الإثنى عشري.
