تنقسم الجرائم التي تقع اعتداء علي حق الملكية إلي طائفتين رئيسيتين: الأولي: هي جرائم الاثراء، وتضم الجرائم التي غايتها الاستيلاء علي مال الغير وترتكب بدافع الطمع في مال الغير وإدخاله علي نحو غير مشروع في ملكية الجاني ويترتب عليها إثراء الذمة المالية للجانى- يقابله إفقار لذمة المجنى عليه- ولو لم يحدث ثمة ضرر بالمال المعتدي عليه، وأهمها جرائم السرقة والنصب وخيانة الأمانة. والثانية هي جرائم الإضرار حيث يلحق الضرر بالذمة المالية للمجنى عليه- دون أن يقابله إثراء في ذمة الجاني- ويتمثل الضرر في إهدار المال أو أنقاص قيمته، فهى جرائم تكون غايتها إتلاف مال الغير وغالباً ما تدفع إلي ارتكابها الرغبة في الانتقام، وأهمها جرائم الحريق والإتلاف والتخريب وقتل الحيوانات، وسوف نخصص هذه الدراسة لجرائم الإثراء فحسب.
وتشترك جرائم السرقة والنصب وخيانة الأمانة في أنها صور لاغتيال مال الغير، ذلك أن سلوك الجانى يتمثل في العدوان علي ملكية الغير وحيازته، كما تتفق في محل الاعتداء وهو المال المنقول المملوك للغير، وتشترك في غايتها المتمثلة في الاستيلاء علي مال الغير، ويلتقى القصد الجنائى فيها في كثير من مقوماته.
وتقتضى دراسة جرائم السرقة والنصب وخيانة الأمانة والجرائم الملحقة بها تقسيمها إلي أبواب ثلاثة علي النحو التالي: السرقة وملحقاتها، النصب والشيك بدون رصيد، خيانة الأمانة.
