لما كانت مشكلة تدني الأجور والتأخر في صرفها هي من أهم المشاكل التي يعاني منها العامل، فضلاً عن اعتبارها أحد أهم أسباب انتشار ظاهرة عدم استقرار علاقات العمل في السلطنة، ارتأيت إجراء هذه الدراسة لعلها تقيد أصحاب العمل والعمال والمسؤولين بالدولة.
لقد التزمت في هذه الدراسة بالمنهج التحليلي، وهو منهج يقوم على أساس تحليل النصوص القانونية وفهمها، وتفسيرها؛ بقصد تطبيقها على الجزئيات، والوقائع المختلفة التي تدخل في مجال هذه النصوص، حيث قمت بتناول أحكام قانون العمل العماني فيما يخص حماية الأجور، كما استعنت بنصوص بعض القوانين المقارنة؛ وذلك للاستفادة منها قدر الإمكان.
معالجتي لهذا الموضوع ستتم من خلال أربعة فصول وخاتمة يسبقها فصل تمهيدي، وسوف أتناول في الفصل التمهيدي ماهية الأجر، من حيث تعريفه لغة واصطلاحاً ثم نتطرق إلى صور الأجر.
أما الفصل الأول من الدراسة فقد خصصته لحماية الأجر من حيث تحديد الحد الأدنى له، وسوف نتطرق فيه إلى التطور التاريخي لنظام الحد الأدنى للأجور في السلطنة وأهدافه ومعايير تحديده، وكذلك نطاق سريان قواعد الحد الأدنى له وعلاقته بالنظام العام.
كما خصصت الفصل الثاني لحماية الأجر في مواجهة صاحب العمل من حيث حماية الأجر من الاقتطاع الظاهر والاقتطاع المستتر، ومدى صلاحية صاحب العمل في نقل العامل من فئة إلى أخرى.
وفي الفصل الثالث نتحدث عن حماية الأجر في مواجهة دائني العامل ومن العامل نفسه من حيث الحد من حجز الأجر وحوالته ومقاصته وتقييد حرية تنازل العامل عن أجره.
أما الفصل الرابع فقد خصص للحديث عن حماية الأجر من حيث تأمين وسائل الوفاء به، وفي الخاتمة سوف نتطرق إلى أهم النتائج والتوصيات التي توصلنا إليها.
