أما بعد فإن موضوع هذا البحث (العفو عن العقوبة فى القانون الجنائى اليمنى- دراسة مقارنة) وأقصد به العفو مطلقاً بكافة صوره أياً كان نوعه ومصدره سواء كان من المجنى عليه أو ولى الدم, أو كان صادراً عن السلطة التشريعية (البرلمان) فى العفو الشامل أو ما يصدر عن رئيس الدولة (العفو الخاص) بإعتباره ممثلاً للدولة بجميع سلطاتها وما تضمنته نصوص القانون فى حالات محددة (العفو القضائى), كل ذلك لإعتبارات قدر المشرع مراعاتها لمصلحة المجتمع.
والعفو بهذا المعنى يشمل كافة صور العفو عن العقوبة وأنواعه ولا ينحصر فى مفهوم العفو عن العقوبة المقصود به (العفو الخاص) لدى فقهاء القانون والذى يعد جزأ من موضوع هذه الدراسة.
