يلقي هذا الكتاب الضوء على التطور التاريخي لموضوع المصادرة في التشريعات العراقية القديمة في زمن حمورابي والتشريعات المصرية والقانون الروماني والقانون اليوناني والعصور المتوسطة والسريعة الإسلامية ويخصص الفصل الأول الى بيان ماهية المصادرة وتعريفها بأنها إجراء القصد منه تمليك الدولة بموجب حكم قضائي كل او بعض أموال المحكوم عليه أو تملكها أصلاً أو المضرور استثناءً بموجب ذلك الحكم أموالاً مضبوطة ذات صلة بجريمة قهراً على صاحبها وبغير مقابل وشروط المصادرة ارتكاب جناية أو جنحة وتكون الأشياء قد تحصلت من الجريمة أو استعمالات في ارتكابها أو كانت معدة لاستعمالها ويجب أن يكون الشيء مضبوطا وعدم الإخلال بحقوق الغير ثم تمييز المصادرة عن الغرامة والتأميم ولاستملاك وفي الفصل الثاني يتناول المصادرة العامة ويعرفها الفقه بأنها عقوبة تنصب على تجريد الحكم عليه من جميع ما يملكه أو من نسبة معينة منه وهي من حيث القسوة تعد أشد العقوبات المالية حيث تقابل عقوبات الإعدام في العقوبات المدنية ثم يشير الى الخصائص المصادر العامة وهي شرعية المصادر العامة وشخصيتها والخاصة المالية للمصادرة العامة ويعدد شروط المصادرة العامة وهي وقوع الجريمة وارتكاب الجريمة وهروب مرتكبيها وارتكاب الجريمة تخالف القانون ثم يعرج على المصادرة العامة والمصادرة الخاصة ثم يبين المصادرة من حيث طبيعتها فهي عقوبة تمليكية والمعالجة التشريعية للمصادرة كعقوبة تمليكية وأثر الدعوى الجزائية على المصادرة التكميلية ثم المصادرة وطرق التنفيذ هي الحجز والتنفيذ والتنفيذ بالمقابل والإكراه البدني.
