كما يدل الاستقراء على أن قواعد قانون العمل هي من أكثر قواعد القانون تطبيقاً في الواقع العمل، وبالتالي فمن الطبيعي أن تكون أكثرها إثارة للمشكلات ليس فقط لأنها تنظم قطاع العمل الخاص، وهو قطاع تتزايد أهميّته في حياة الشعوب نتيجة الانفتاح الاقتصادي والاتجاه نحو الرأسماليّة واقتصاديّات السوق، وإنما أيضاً لأنّه قانون يُخاطب شريحة كبيرة ذات تأثير مهم في حياة المجتمع هي شريحة العمالة من ناحية، بجانب أّنه قانون حركي دائم التطبيق من ناحية ثانية.
لكنّ هذا، وبدافع تبسيط أحكام هذا القانون لكافة المخاطبين بها، لاسيما طبقة العمال، والوقوف على أهم مبادئ وأُسس التطبيق السليم لقواعده، اتجه التفكير، إنقاذاً للتكليف الصادر لنا من كليّة الحقوق جامعة السلطان قابوس، إلى إعداد دراسة تكون بسيطة في فكرتها على الطالب المبتدئ وفي نفس الوقت عميقة فيما تهدف إليه من تزويده بالمبادئ الأساسيّة التي تُهيمن على تشريعات العمل المقارنة وفي القلب منها قانون العمل العماني. ولذا فنحن، أمام دراسة لا تُحاكى الدراسات السابقة، لا من حيث الخطة والمنهج الذي سارت عليها، ولا من حيث أهدافها ومراميها، ولا من حيث وسائلها.
