Book Description
يتكلّم الفقه، في مؤلفاته، عن تقسيم العقود إلى عقود مسماة وعقود غير مسماة. قاصداً بالأولى العقود التي شاع استعمالها في الحياة العمليّة فاكتسبت أهمية كبيرة، فنظمها المشرع تنظيماً خاصاً، وأعطاها إسماً معيناً، وشيّد لها بناء قانونيّاً يليق بمكانتها العلمية والعملية، أما الطائفة الثانية فهي أقل شيوعاً وانتشاراً، وبالتالي، أقل أهمية ومن ثمّ فلم ينظم المشرع أحكامها ولم يعطها اسماً خاصاً، بل ترك حكمها للقواعد العامّة التي نص عليها القانون المدني في إطار النظريّة العامّة للإلتزام.
و الجدير بالذكر أن العقود المسماة هي عقود متنوعة بحسب تنوّع المحل الذي ترد عليه فمنها ما يرد على الملكية، كالبيع والهبة والمقايضة، ومنها ما يرد الانتفاع، كالعارية والإيجار، ومنها ما يرد على العمل، كالعمل والمقاولة، ومنها ما يقصد به استيثاق الدائن لحقه، كالكفالة والرهن، ومنها ما يرد على أمور احتمالية، كالخطر والتأمين.
وطبيعي، لضيق الوقت، ولدواعي الخطط الدراسية بكليات الحقوق المختلفة إلا تنبسط الدراسة الماثلة لتشمل جميع العقود المسماة المذكورة، بل تضيق لتقف عند قمتها من حيث الأهميّة والشمول والأثر في تكوين الملكة القانونية لدى الطالب في هذه المرحلة.
ومن هنا، اقتصرت هذه الدراسة على تناول كل من عقد البيع وعقد الإيجار كل في كتاب مستقلّ على النحو التالي: الكتاب الأوّل: عقد البيع؛الكتاب الثاني:عقد الإيجار.
