منح المشروع مأمور الضبط القضائى من رجال الشرطة سلطة القبض على مرتكب الجريمة، في أحوال معينة، بأعتباره من أكبر أعوان السلطة القضائية في أداء رسالتها، وأداة المجتمع فى سلطان القانون تحقيقأ للصالح العام، وأن القبض الذي يقوم به يعتبر الخطوة الأولي لسلسة من الإجراءات الجنائية اللاحقة.
ويعتبر القبض الذي يقوم به مأمور الضبط القضائي إجراء استثنائيا، وكانت القواعد الأصولية تقتضي بأن لا يتوسع فى الاستثناء، أو استنتاجه ضمنيا، أو التوسع فى تفسيره ، أو القياس عليه، مما يتعين أن يقدر هذا الاستثناء بقدره، وأن يباشر وفق ضوابط معينة وردت في نصوص قانونية صريحة.
لأنه لا يضير العدالة إفلات مجرم من العقاب بقدر ما يضيرها الافتئات على حريات الناس والقبض عليهم بدون وجه حق.
ولكل ما تقدم ولأن القبض الذى يقوم به مأمور الضبط القضائى يعد من الإجراءات الماسة بالحرية الشخصية للإفراد، فقد اخترناه ليكون موضوع بحثنا.
