يتمحور هذا الكتاب حول معرفة ما إذا كان النظام الفدرالي العراقي بعد سقوط النظام السابق، قد التزم فعلاً بالنتائج المفترض إحداثها في النظام الدستوري والقانوني بالنسبة لوضع السلطة القضائية من نواحي الإستقلال والتكوين والإختصاصات.
وفي هذا السياق يضع المؤلف دراسة تحليلية ومقارنة للأنظمة القضائية في الدول الفدرالية السابقة في هذا المجال، معرّفاً باستقلال القضاء، مضامينه وضماناته وانعكاساته على حياة المواطن وعلى حقوقه المادية والمعنوية وموضحاً دور هذا الإستقلال في ضمان سيادة القانون في الدولة وحماية لحرية المواطن بالإختيار وترسيخ النظام الديمقراطي والحيلولة دون تسلط الحكم الشمولي. بعد ذلك يستعرض المؤلف النظام القضائي في العراق ويبيّن دور مجلس القضاء الأعلى في ترسيخ استقلال السلطة القضائية في العراق، وقد أظهر دور الإدعاء العام في حماية المشروعية ومركزه القانوني في الحكومة الإتحادية في إقليم كوردستان. ثم عرج على دور مجلس القضاء في إقليم كوردستان، تشكيله ومهامه، وماله، وما عليه وخصوصاً الإدعاء العام وارتباطه بوزارة العدل في الإقليم، ثم تطرق إلى المحكمة الإتحادية العليا في العراق وتشكيلها ودورها في الرقابة على دستورية التشريعات وفي حفظ التوازن بين الحكومة الإتحادية وحكومة الإقليم والمحافظات التي لم تنتظم بإقليم، مع إدراج المؤلف للكثير من قرارات هذه المحكمة، فجاءت الدراسة شاملة من حيث (النظرية والتطبيق) وبهذا يمكن لها أن تكون مرجعاً أساساً لكل قاضٍ وقانوني وباحث يريد أن يحيط بالنظام القضائي في الدول الإتحادية بصورة عامة وفي العراق الإتحادي بصورة خاصة ...
