إن استخدام اجهزة الحاسبات الآلية تولد عنها بعض الأفعال التي تقع تحت طائلة قانون العقوبات، مما أثار كثير من الجدل لجدة المشاكل التي نشأت عن هذا الإستخدام، وكذا الجدل المثار عند تطبيق النصوص التقليدية على تلك المشاكل المستحدثة.
فقد تقع الجرائم على الحاسب الآلي ذاته، ومن ناحية أخرى قد تقع الجرائم على برامج الحاسب الآلي، فتأخذ شكل المساس بسرية البرامج أو الإتلاف أو العبث بالبيانات والمعطيات في ذاكرته.
ومن ثم ظهرت المشكلة الحقيقية والتي لا تتمثل في استخدام الحاسبات الآلية، بل تكمن في عجز أجهزة العدالة عن ملاحقتهم عن الجرائم التي يرتكبونها. وهذا الفراغ التشريعي بدأ في الظهور نتيجة لعدم تجاوب القانون مع الاحتياجات التي تولدها متغيرات العصر، مما يستدعي تغيير القوانيين لتواكب متغيرات العصر بما يتلائم مع أٌستجد في الحياة من تقنيات حديثة.
لكل ما سبق كان من الاهمية بمكان دراسة ظاهرة الإجرام المعلوماتي والتعرض لهذه الظاهرة من حيث ما تحتويه من جرائم مختلفة، وماهية الوسائل التشريعية التي أقرتها الدول لمواجهتها، وبيان درجة فاعلية هذه الوسائل في تحقيق الحماية الجنائية المطلوبة للحاسوب الآلية ذاتها وما تحتويه من برامج ومعلومات.
وتنقسم دراستنا لجرائم الحاسبات الآلية في التشريع المصري إلى قسمين، يتضمن أولهما النظرية العامة لجرائم الحاسبات الىلية من خلال بابين، نتناول في الباب الأول المقصود بفلسفة الحماية الجنائية لأنظمة الحاسبات الآلية والمصالح المرتبطة باستخدامها، وفي الباب الثاني الأحكام المشتركة في جرائم الحاسب الآلي.
أما القسم الثاني فنتناول فيه أهم صور جرائم الحاسب الآلي من خلال بابين أيضاً، يضم الأول الجرائم التي تقع ضد الحاسب الآلي، وفي الثاني الجرائم التي تقع باستخدامها، إلا إننا قد آثرنا أن نبدأ دراستنا بفصل تمهيدي توضح من خلاله المقصود بالحاسب وعلاقته بالسلوك الإجرامي.
