فى الحكم مباحث وموضوعات كثيرة تستحق الدراسة أهمها القواعد التى تحكم إتفاق التحكيم وتشكيل هيئة التحكيم وإجراءات خصومة التحكيم. وينحصر موضوع هذه الدراسة فى عمل من أعمال خصومة التحكيم يمثل العمل الختامى لها وهو العمل الصادر عن المحكم او هو حكم التحكيم. وينحصر إطار هذه الدراسة فى مجال حم التحكيم الصادر فى المنازعات الخاصة أى فى المنزعات الناشئة عن العلاقات الخاصة, والتى إشتهر فى التعبير عنها تشريعياً وفقهياً بإصطلاح العلاقات المدنية والتجارية. وعليه فلا نعرض لأحكام التحكيم فى المنازعات التى تنشأ بين الدول, ولا لتلك التى تنشأ بين الدول من جهة و أفراد القانون الخاص من جهة أخرى.
وسوف نتناول فى هذه الدراسة حكم التحكيم من كافة جوانبه؛ تحديد مقصود به وبيان طبيعته القانونية والتمهيد لإصداره وتكوينه وكيفية إصداره والأثار التى تترتب عليه ونظام الطعن عليه القواعد التى تحكم تنفيذه, وذلك من خلال خمسة أبواب رئيسية نخصص الأول للتعريف بحكم التحكيم وبيان الإجراءات التمهيدية التى تسبق إصداره, والثانى لبيان كيفية تكوينه و إصداره, والثالث أثاره, والرابع لنظام الطعن عليه والخامس لكيفية تنفيذه. على أننا نرى أن من الضرورى أن نستهل هذه الدراسة بباب تمهيدى نخصصه للتعريف بنظام التحكيم. وعلى ذلك فسوف تكون خطة دراستنا على النحو التالى: باب تمهيدى: فى التعريف بنظام التجكيم, الباب الأول: فى التعريف بحكم التحكيم و الإجراءات التمهيدية لإصداره, الباب الثانى: تكوين حكم وإصداره, الباب الثالث: أثار حكم التحكيم, الباب الرابع: نظام الطعن على أحكام التحكيم, الباب الخامس: تنفيذ حكم التحكيم.
