يقتضي المنطق ونحن نطرح للبحث موضوع حرية التظاهر كمظهر من مظاهر التعبير عن الرأي، أن نمهد لدراستنا بالوقوف على بعض المفاهيم العامة المتعلقة بهذه الحرية، والمظاهرات تؤدي وظيفتها في التنفيس عما يجيش بداخليات بعض المواطنين، وكذلك في تكوين وتوجيه الرأي العام من خلال التنظيم الذي تقرره هذه الدولة أو تلك. وعلى قدر ديموقراطية هذا التنظيم على قدر نجاح حرية التظاهر في أداء دورها. إلا أن كفالة التنظيم القانوني لا يفي بالغرض ما لم يقترن به وضع الضمانات اللازمة لتفعيله، فإلى أى مدى ضمنت نصوص قانون تنظيم الإجتماعات العامة والمظاهرات في جمهورية مصر العربية وبعض الدول العربية هذه الضمانات؟
تفحص هذه النصوص يكشف بجلاء أن المشروع المصري ونظيره في معظم الدول العربية قد وضع قيوداً ثقيلة بالنسبة لممارسة الأفراد لحرياتهم في التظاهر، وهو ما سيتأكد لنا من دراستنا للموضوع عبر المحاور الثلاثة التالية: " مفاهيم عامة حول حرية التظاهر، ضمانات حرية التظاهر، التنظيم القانوني لحرية التظاهر".
