وقد اخترنا أن تنطلق دراستنا بالتعرف على أبعاد اختصاص المحمة الدستورية العليا بالدعوى الدستورية، ولن تتحقق تلك المعرفة دون بحث هذه الأبعاد قبل إنشاء المحكمة الدستورية ومن قبلها المحكمة العليا، ويمهد الإلمام بالجزئية السابقة إلى بحث الطريقة التي ترفع بها الدعوى الدستورية أمام المحكمة المختصة، لبيان إذا ما كانت هذه الدعوى يمكن رفعها من قبل الأفراد أم أن الأمر محصور بيد كل من قاضي النزاع والقاضي الدستوري، والتسليم التشريعي بحق كل من القاضي والأفراد في رفع الدعوى الدستورية يفرض علينا بيان ما تقتضيه هذه الدعوى من شروط شكلية مثل المصلحة والصفة والميعاد، وشروط إجلاائية مثل تحضير الدعوى أمام هيئة المفوضين، ويلي بحث الشروط الشكلية للدعوى الدستورية التطرق إلى أوجه الطعن بعدم الدستورية، موضحين الحالات التي يخالف فيها التشريع قواعد الدستور، ويبقى في النهاية إلقاء الضوء على الحكم الصادر في الدعوى الدستورية.
من جماع ما سبق نستخلص المحاور الخمسة التي ستدور حولها هذه الدراسة:-
الفصل الأول: مفهوم الدعوى الدستورية وطبيعتها القانونية، الفصل الثاني: مقومات الدعوى الدستورية وموضوعها، الفصل الثالث: الاختصاص بدعوى الدستورية، الفصل الرابع: كيفية اتصال المحكمة بالدعوى الدستورية، الفصل الخامس: شروط قبول الدعوى الدستورية، الفصل السادس: أوجه الطعن بعدم الدستورية، الفصل السابع: الحكم في الدعوى الدستورية، ومن المفيد أن نمهد لتلك الدراسة بفصل تمهيدي يمثل مدخلاً لدراسة الدعوى الدستورية، حيث نتناول فيه: أساليب الرقابة على دستورية القوانين.
