كشف التطبيق العملي عن قصور التنظيم القانوني فيما يتعلق بمخالفات وجرائم المرور إذ أن التطور العلمي وما صحبه من تقدم بالنسبة للمركبات جعل من الطريق العام خطراً على الأرواح والأموال إن لم يعمل المشرع على تحقيق الأمن اللازم.
ومن أجل ذلك صدر عدة تشريعات في مصر بهدف تنظيم أمن الطريق فصدر قانون المرور رقم 66 لسنة 73 الذي لحق به العديد من التعديلات لمواكبه التطور العلمي السريع.
وقد قدر أن مخالفات المرور أصبحت يوقع على مرتكبيها عقوبات رادعة كالحبس أو الغرامة بما يلحق بها من عقوبات سحب التراخيص أو إلغاءها أو وقفها ينبغي أن يعهد بتوقيعها السلطة القضائية ولم تصبح جهة الإدارة لها سلطة في هذا الشأن سوى تنفيذ الإجراءات ومتابعتها.
أما توقيع الجزاءات فهو حق أصيل للقضاء ومن ثم كان إنشاء محكمة المرور بدرجتها الأولى والثانية على النحو الذي سوف نحاول الوقوف عليه وستناول في هذا البحث الأحكام الموضوعية لجرائم المرور ثم الأحكام الإجرائية لها في فصلين على النحو التالي: الفصل الأول: الأحكام الموضوعية لجرائم المرور -الفصل الثاني: الأحكام الإجرائية لمحكمة المرور.
