بالنسبة إلى المجرمين الأطفال فإنه بالنظر إلى نقص خبرتهم وقلة وعيهم وعدم إكتمال إرادتهم لا ينتهك إجرامهم الشعور بالعدالة. كما أنهم لصغر سنهم لا يكونو غالباً قدوة لغيرهم, ويعنى ذلك أن يستبعد من أهداف معاملتهم العدالة والردع العام إلا فى نطاق محدود. فلا يبقى سوى هدف أساسى وهام هو تحقيق الردع الخاص للمجرم الصغير, ويكون ذلك عن طريق حمايته من المؤثرات المفسدة وتهذيبه وإصلاحه وتأهيله, ويؤدى ذلك إلى إكتفاء المشرع فى كثير من الأحيان بأن يقرر التدابير التى تحقق هدف التهذيب والتأهيل. ويكون لمحكمة الطفل سلطة واسعة فى توقيع تدابير غير محددة المدة عليه دون شرط- كما هو الشأن فى العقوبة- تناسبها مع الجسامة الموضوعية للجريمة. فالحكم على الطفل المجرم يجب الا يصدر فى ضوء الفعل الذى إرتكبه وإنما فى ضوء شخصيته, وظروف إرتكابه الجريمة, الوضع المادى والمعنوى للاسرة التى يعيش فيها.
ودراسة محاكمة الطفل المجرم تقتضى البحث فى المعاملة الجنائية لهم ونتناول فى فصلين الأحكام الموضوعية والإجرائية لهم بشأن المعاملة العقابية للأطفال على النحو التالى:
الفصل الأول: الأحكام الموضوعية للمعاملة العقابية للأطفال.
الفصل الثانى: الأحكام الإجرائية للمعاملة العقابية للأطفال.
