نستبعد من هذه الدراسة التحكيم في مجال القانون الدولي العام، أي التحكيم في المنازعات التي تنشأ بين الدول، كما نستبعد أيضًا التحكيم الذي يهتم به القانون الدولي الخاص من زاوية مشكلات تنازع القوانين والقانون الواجب التطبيق. وسنعالج من خلال هذه الدراسة نظام التحكيم اليمني وفي القانون المقارن وقوته الملزمة ومصادره وأساسه لنصل إلى أهميته في الحياة اليمنية.
كما أننا سندرس التحكيم القبلي في اليمن لكونه تحكيمًا يستند إلى العرف في اليمن، وكونه ضروريًا لحل المنازعات عند غياب الدولة أو ضعفها في الفترة السابقة على دولة اليمن الحديثة، موضحين التحكيم وإجراءات التحكيم في المجتمعات القديمة بشكل عام مركزين على المجتمع اليمني القديم بصفة خاصة. ولئن كان القانون اليمني يجد أساسه في الشريعة الإسلامية، لذلك حاولت أيضًا دراسة التحكيم في الفقه الإسلامي والقواعد المتبعة عند حل النزاع في ذلك ومقارنته بالقوانين الوضعية وقد أفردنا عنوانًا مستقلًا لموضوعات الفقه الإسلامي ليكون بارزًا وواضحًا للقارئ.
وسوف تكون دراستنا قاصرة على التحكيم الاختياري في المسائل التي يجوز فيها التحكيم وحدها في نطاق القانون الداخلي. وعلى ذلك نقسم هذه الدراسة إلى قسمين: القسم الأول: وفي هذا القسم نتكلم عن الخصائص العامة لنظام التحكيم، أما القسم الثاني: يتضمن هذا القسم شرحًا لعناصر نظام التحكيم طبقًا للقانون اليمني رقم (22) لسنة 1992م دراسة مقارنة.
