سنحاول في هذا البحث توضيح الشروط الخاصة الواجب توافرها للتنفيذ ضد الكفيل من خلال قواعد واحكام قانون التنفيذ كونه جاء بأحكام وقاعد يلزم اتباعها عند التنفيذ الجبري، ومنها حق الكفيل في الدفع بالتجريد طبقاً للمواد (336، 347) من قانون التنفيذ الجبري، وبالتالي لا يجوز التنفيذ عليه إلا بموجب سند تنفيذ صادر في مواجهته (الكفيل)، أي لا يعتد بالسند الصادر في مواجهة المدين (المكفول عليه).
مما سبق يتضح ملامح هذا البحث من خلال الإجابة على التساؤلات الآتية: هل يجوز مطالبة الكفيل وحده قبل مطالبة المدين (المكفول عليه)؟ أم يلزم مطالبة المدين (المكفول عليه) أولاً؟ وما الجزاء المترتب على مطالبة الكفيل وحده؟ وهل يصلح السند التنفيذي الصادر في مواجهة المدين للتنفيذ ضد الكفيل؟ وهل يجوز التنفيذ ضد الكفيل قبل التنفيذ على أموال المدين؟ وما هي الإجراءات المتبعة للتنفيذ ضد الكفيل؟ وبالإجابة على هذه التساؤلات نصل إلى الشروط الخاصة الواجب توافرها ضد الكفيل وعلى ذلك نقسم هذا البحث إلى المباحث الآتية:
