Book Description
التنفيذ الجبري، يكون في حالة عدم إنصياع المدين لمضمون السند التنفيذي، الذي يتضمن إلزامه بأداء معين، في مواجهة الدائن، مما يخول الدائن سلطة اللجوء إلي الجهة المختصة التي تستطيع جبر المدين علي تنفيذ التزامه جبراً وقهراً عنه، وتستطيع تلك الجهة، التنفيذ علي أموال المدين، بهدف إستيفاء الدائن حقه من الأموال، وهو ما يعرف بالإكراه المالي، كما لها أن تقوم بالتنفيذ علي شخص المدين من خلال حبسه، أو منعه من السفر، كوسيلة للضغط عليه لتنفيذ التزامه، وه ما يعرف بالإكراه البدني.
وقد نظم قانون الإجراءات المدنية والتجارية العماني الأحكام المتعلقة بالتنفيذ الجبري في الكتاب الثاني وفي خمسة أبواب، وذلك في المرسوم السلطاني رقم (29) لسنة 2002 المنشور في عدد الجريدة الرسمية رقم (715), والمراسيم المعدلة له المرسوم السلطاني رقم (92) لسنة 2005 المنشور في عدد الجريدة الرسمية رقم (802)، والمرسوم السلطاني رقم (119) لسنة 2006 المنشور في عدد الجريدة الرسمية (829).
وقد استقي قانون الإجراءات المدنية والتجارية العماني، في التنظيم التشريعي للتنفيذ الجبري، معظم أحكامه من قانون المرافعات المدنية والتجارية المصري، المتأثر بقانون الإجراءات المدنية والتجارية الفرنسي، ولم يفرد المشرع العماني قانوناً خاصاً للتنفيذ الجبري، بل عالجه ضمن قانون الإجراءات المدنية والتجارية.
سيعالج المؤلف موضوع التنفيذ الجبري في القانون العماني في خمسة فصول: (أشخاص التنفيذ، السندات التنفيذية، محل التنفيذ، إجراءات التنفيذ علي مال المدين، حبس المدين ومنعه من السفر).
