تشهد الحياة القانونية الخاصة المشوبة بعنصر أجنبي، تطوراً كبيراً على مستوى العلاقات الإقتصادية والإجتماعية. لا سيما بعد التطور الهائل لوسائل الإتصالات، إذ مر الالعالم بما يسمى بثورة الإتصالات في مختلف ميادين الحياة، فلم يعد هناك وجود إفتراض لدولة تقوم على الإنغلاق والفردية والإنعزال، تطبق قانوناً واحداً هو قانونها الوطني على جميع العلاقات القانونية سواء كانت وطنية أم مشوبة بعنصر أجنبي، بل أن الدول تقوم اليوم على الإنفتاح، فالأشخاص والأموال تنتقل عبر الحدود من دولة إلى أخرى. ذلك أن المجتمعات الدولية لا تستطيع الإستغناء عن بعضها بسبب ضرورات الحياة ومتطلباتها وحاجة التجارة والإقتصاد الدولي، وما تقرره مبادىء العدالة واحترام الحقوق المكتسبة والتي تقضي بضرورة الإتصال والتعامل وتنقل الأفراد بين الدول. فالمجتمعات الدولية لم تعد مقيّدة بحدودها السياسية، بل أصبحت تتعدى هذه الحدود.
ومن هنا تأتي أهمية القانون الدولي الخاص في وضع الحلول للعلاقات القانونية المشوبة بعنصر أجنبي وحسم المنازعات الناشئة عن هذه العلاقات. ولا ريب أن القانون الدولي الخاص، بعدّ من أكثر فروع القانون سعة في الدراسة والبحث، ويواجه الباحث فيه صعوبات حقيقية ليس بالأمر اليسير، لاتصال هذا القانون بكل فروع القانون، فهو قانون اختلف الفقه على مواضيعه ومصادره وطبيعة قواعده، فضلاً عن ذلك أن لكل دولة نظامها القانوني الخاص بها.
وفي العراق تشمل دراسة القانون الدولي الخاص، الجنسية والموطن ومركز الأجانب وتنازع القوانين والإختصاص القضائي الدولي وتنفيذ الأحكام الأجنبية.
وهذا الكتاب هو حصيلة جهد تضمن شرحاً تفصيلياً لأحكام قانون الجنسية العراقية رقم 26 لسنة 2006 وأحكام الموطن ومركز الأجانب. ويتوجه الكتاب إلى الطلاب والقضاة والمحامين وإلى كل المهتمين بشؤون هذا القانون. وقد تم توزيع الكتاب إلى الأبواب الثلاثة الآتية:
الباب الأول: قانون الجنسية العراقية.
الباب الثاني: الموطن.
الباب الثالث: مركز الأجانب.
