بعد أن انتهينا من الجزء الأول من هذه الموسوعة والذي خصصناه للتصدي لمشكلة تنازع القوانين، سنتناول بعون الله وتوفيقه مسائل الجنسية والموطن ومركز الأجانب كموضوعات تدخل وفقاً للراجح من أراء الفقهاء وعمداء القانون الدولي الخاص ضمن صميم موضوعات القانون الدولي الخاص. والتصدي لموضوعات الجنسية والموطن ومركز الأجانب له من الأهمية ما يبرر إبرازها كواحدة من أهم موضوعات القانون عموماً وليس أقل من التدليل على صحة وسلامة هذه الخلاصة من التأكيد على أن عنصر وركن الشعب في أي دولة يبرز وتتحدد معالمه وفقاً لكل من الجنسية أو الموطن على اعتبار أن الفرد لا بد له من الارتباط مادياً ومعنوياً مع الدولة التي يتفيأ بظلالها ويتنسم عبيرها ويمنحها الشعور بالولاء والانتماء، أو على الأقل الارتباط ببقعة جغرافية معينة ارتباطاً فعلياً وواقعياً يجعله يشعر فيما لو ارتحل بعيداً عنها بالحنين والشوق لها والأمل بالعودة إليها، وبخلاف ارتباط الفرد مع الدولة أو مع الموطن تجعل من الشخص أجنبياً بمعنى غريباً عن مجتمع معين أو عن إقليم معين فنراه لا يحس بإحساس الشخص المنتمي لتلك المنظومة ولا يتنفس هواء تلك البقعة فيكون أجنبياً عن هذه وعن تلك. ولهذا نرى أن دراستنا للجنسية كرابطة بين الفرد ودولته أو الموطن كرابطة بين الفرد والإقليم ستؤدي بنا حتماً إلى التطرق إلى موضوع الأجانب على اعتبار أن الأجنبي ــ كما سيمر معنا لاحقاً ــ هو كل شخص غير مرتبط بدولة معينة أو بإقليم معين برباط فعلي وواقعي ولكنه لظرف أو لآخر موجود داخل هذه الدولة أو ضمن حدود ذلك الإقليم ولكنه وجود عابر وطارئ لا ينم عن رابطة فعلية وواقعية بينه وبين الدولة المستضيفة له ولا بينه وبين الإقليم الذي يتنفس الهواء المنتشر في سمائه. ولا أبالغ إذا قلت بان موضوعات الجنسية والموطن ومركز الأجانب تعتبر من الموضوعات التي فرضت نفسها علي كباحث على اعتبار أنها من الموضوعات الشيقة والجاذبة لأقلام المهتمين وذلك لأكثر من سبب:
