تعد العقود النفطية الأداة القانونية الأساسية التي تنظم إستغلال الثروة النفطية في دول منظمة الأوبك وتبين أهميتها بالنسبة لبحثنا هذا سعي القوى الدولية العظمى لتأمين حاجاتها من إمدادات الطاقة وما يتطلبه ذلك من نظام قانوني وتنظيم دولي تمثل بمنظمتي الأوبك OPEC ومجموعة الدول المستقلة المصدرة للنفط LPEC من جهة ووكالة الطاقة الدولية International Energy Agency التي تضم مصالح الدول الصناعية الغربية وتمثلها وتخدمها وبالمقابل برز أثر القانون الدولي عن طريق مبدأ سيادة الدول الدائمة على ثرواتها الطبيعية وأثره في أرض الواقع من حيث العوامل التي تحد أو تفعل تطبيقه.
فضلاً على الإقرار بنظرية تغيير الظروف وأثرها في تعديل العقود النفطية وبما يؤدي إلى قدر أكبر من التوازن بين حقوق الطرفين المتعاقدين وواجباتهم، وقد نتج عن هذين المبدأين أوضاع ومراكز قانونية جديدة.
وقد اختيرت بعض العقود والتجارب من دون غيرها بوصفها أنموذجاً ويمكن القول أن باقي العقود تنطوي تحته وقد استعمل المؤلف أسلوب المقارنة إذ سيبرز أوجه الشبه والإختلاف في النظم المتبعة في دول الأوبك في مجال إستغلال الثروات النفطية للمدة من عام 1952م غلى عام 2000م لقد حاول البحث مواكبة التغيرات الأساسية والمستمرة على أرض الواقع ووسائل القانون الدولي في التفاعل مع هذا الواقع بخلق وسائل قانونية تضاهي التغير الحاصل في عالم الواقع السياسي والإقتصادي من أجل الوصول إلى تحقيق غايته المتمثلة في حل مشاكل الدول وإقامة التوازن في العلاقات الدولية وخلق نقاط مشتركة تلتقي حولها مصالح الأطراف الدولية.
