إن الجراحات التجميلية من أبرز وأخطر الجراحات التي يجريها الإنسان كونها ترتبط بالقدسية التي تضفى على جسم الإنسان. لذلك اوجدت مجالاً خصباً للنقاش والجدل العلمي. ففي نهاية القرن العشرين وحلول القرن الواحد والعشرين ازدادت الرغبة في إجراء العمليات التجميلية في جميع أنحاء العالم ومنها الدول العربية ولم تعد هذه العمليات قاصرة على النساء بل استقطبت الكثير من الرجال والمشاهير ورجال الأعمال الميسورين بل حتى المجرمين رغبة منهم في التخفي وتغيير معالم الشخصية فراراً من القضاء. لكن قابل هذا الإنتشار مآسي عديدة ومشاكل كبيرة مطروحة أمام القضاء كان لا بد من إيجاد الحلول الناجعة لها، إذ أن اتساع وانتشار الجراحة التجميلية وكثرة وسائلها أدى إلى زيادة في الأخطاء والأخطار التي يتعرض لها طالب الجمال، الأمر الذي يقتضي غطاءاً تشريعياً لهذه العمليات التجميلية لتنظيمها ووضع الحلول والمعالجات اللازمة لها وتحديد مسؤولية الجراح التجميلي بالدقة المتناهية، هذه المسؤولية التي ترتبط إرتباطاً وثيقاً بتحديد طبيعة التزام الجراح التجميلي فيما إذا كان التزاماً بتحقيق غاية أو نتيجة بحيث تقوم مسؤوليته بمجرد عدم نجاحه أو إخفاقه في العملية، أم إن التزامه يعد التزاماً بوسيلة (بذل عناية) شأنه شأن الجراحين الآخرين.
ويحاول هذا البحث تتبع الإتجاهات القانونية والشرعية وكذلك الإتجاهات القضائية الفرنسية والعربية من هذا الموضوع.
