إن فكرة الحماية التي كرست حرمة الجسم هي ذاتها التي تبيح المساس به، بالنظر الى أن حماية الجسم تعني صونه والدفاع عنه إزاء كل ما يتهدده للحفاظ على فكرة السلامة العامة له والتي تجنب الجسم المخاطر والآلام، وللتغلب عليها يستدعي الأمر التدخل الجراحي الذي يمس بالجسم من أجله ولمصلحته، لتحقيق هدف سامٍ وهو العلاج، وهو السند القانوني الذي يجعل العمل الطبي مباحاً وفقاً للشروط وقواعد يحددها القانون وإن إباحة المساس الطبي بجسم الإنسان ولو عن طريق إجراء عمليات جراحية مهما بلغت جسامتها يبرره حق الطبيب في تحقيق هدف أسمى وهو العلاج، غير أن العلاج لا يقتصر على الجراحة العلاجية وهي التي تعنى بعلاج الامراض فيكون قصد الشفاء ملحوظاً فيهـا وإنما يوجد إلى جانبها جراحات أخرى، منها جراحة الشكل أو التجميل، والتي لا يكون الغرض منها علاج مرض، بل إزالة تشويه بالجسم، فهي جراحة تتعلق بالشكل (الحمد لله خالق الإنسان في أحسن صورة وتقويم).
