الواضح أن علاقة مجلس الأمن كجهاز سياسي بالمحكمة الجنائية الدولية- كجهاز قضائي- من شأنها أن تضع هذه الأخيرة أمام تحديات صعبة، وذلك لاشتمالها على بعض المسائل التي من الممكن استغلالها في سببيل الحد من استقلالية هذه المحكمة وقيامها بمهمتها القضائية على أكمل وجه.
وإحساساً منا بالأهمية البالغة لهذا الموضوع من الناحيتين العلمية (النظرية) والعملية (التطبيقية)، فقد رأينا أن نبحث في حدود سلطات مجلس الأمن وفقاً للنظام الأساسي للمحكمة الجنائية الدولية؛ لأن في هذه العلاقة الكثير من المسائل التي تحتاج إلى التوقف عندها وتوضيحها، إضافة إلى قرارات مجلس الأمن ذات الصلة والتي تكشف عن جزء كبير من طبيعة تلك العلاقة.
لذا فإن موضوع سيتضمن بابين يحتوي كلاً منهما على فصلين، الغاية منهما تغطية الجوانب الجوهرية للدراسة أو ما يفترض أنه يغطي هذه الجوانب.
ووفق التسلسل المنطقي للخطة المقترحة، فقد تضمن الباب الأول من هذه الدراسة إبراز دور مجلس الأمن في تفعيل اختصاص المحكمة الجنائية الدولية، حيث تناول الفصل الأول من هذا الفصل سلطة الإحالة من المجلس كآلية لتفعيل اختصاص هذه المحكمة، فيما تضمن الفصل الثاني محاولة استكشاف الآثار الناجمة عن سلطة المجلس في الإحالة على عمل المحكمة.
أما الباب الثاني من هذه الدراسة فقد حاولنا تخصيصه لإبراز دور مجلس الأمن في تجميد اختصاص المحكمة وفق الآليات التي سمح المؤتمرون بتمريرها في الصياغة النهائية للنظام الأساسي.
