لقد أتيح لنا تدريس مساق قانون العقوبات في كلية الشرطة بدولة الإمارات العربية المتحدة عبر ست سنوات، سمحت لنا بإلمام- في حدود إمكانياتنا- نعتقد أنه كبير وكاف، لوضع أيدينا على بعض النصوص التي يتضمنها هذا القانون، وتبدو- استنادا إلى أسباب نعتقد أنها معقولة- في حاجة إلى إعادة نظر. ومما قد يعطي لهذه الدراسة قدرا من الأهمية، أن أصواتا كثيرة بدأت تنادي بضرورة إعادة النظر في قانون العقوبات، على الرغم من حداثته.
وسوف نركز في هذه الدراسة على بيان أوجه القصور التي نعتقد في وجودها، وتلك التي كشف عنها العمل، وذلك عبر أحكام القضاء. ومؤدى ذلك أننا لن نقوم بتتبع كافة نصوص قانون العقوبات الاتحادي، فذلك يتجاوز نطاق هذه الدراسة ويجعلها تتجه إلى شرح لقانون العقوبات الاتحادي أكثر منها دراسة نبتغي من ورائها إظهار جوانب النقص فيه، خاصة أن جل نصوص هذا القانون لا تثريب عليها. وسوف نستعين في ذلك بأحكام القضاء، وخاصة قضاء المحكمة الاتحادية العليا، وكذلك القانون المقارن. ولن يكون منهجنا ترجيح وجهة نظر على أخرى، وإنما الاستناد إلى معايير قانونية مجردة.
وذلك فى الفصول الثلاثة الآتية، الفصل الأول- غموض الإحالة إلى أحكام الشريعة الإسلامية في جرائم الحدود والقصاص والدية والنتائج المترتبة على ذلك، الفصل الثاني- دراسة نقدية لبعض الأحكام العامة في قانون العقوبات الاتحادى، الفصل الثالث- دراسة نقدية لبعض أحكام القسم الخاص.
