إن قواعد القانون الجزائي أشد القواعد القانونية على الإطلاق إذ هي تنصب على الإنسان بوصفه جاني فتمس حريته أو بدنه أو ماله وربما طالت حياته؛ ولذا أراد المشرع أن يحيط تطبيق تلك القواعد بضمانات تكفل إلا تطال غير مذنب من جهة، وتكفل لكل مواطن حياة طبيعية دون تنغيص السلطة.
وقد تصدى المشرع الاتحادي بدولة الإمارات العربية المتحدة لهذه المعادلة التشريعية في أخطر مجالات القانون، وذلك بإصدار قانون الاجراءات الجزائية، وقد حوى هذا القانون مواد إصدار وبابا تمهيدياً وخمسة كتب حوت كافة مناحي الحالة الجنائية والجزائية من شواهد الجريمة إلى تنفيذ الحكم الصادر، فخصص الكتاب الأول للدعوى أمام المحاكم الجزئية، وتضمن الكتاب الثاني استقصاء الجرائم وجمع الأدلة وتحقيقها، ونظم الكتاب الثالث المحاكم، وحوى الكتاب الرابع تنفيذ الأحكام والقرارات الصادرة، أما الكتاب لاخامس فقد حوى أحكاماً متنوعة.
