ينظم التقنين المدني بحسب الأصل الأحوال الشخصية والمعاملات المالية ولكن تقنيننا المدني سكت عن تنظيم الأحوال الشخصية. الأحوال الشخصية فلم يتضمن في هذا الخصوص سوى النصوص المتعلقة ببدء الشخصية وانتهائها والقرابة والأحكام الأساسية فى الأهلية ويبدأ التقنين المدني بباب تمهيدي يشتمل على ثمان وثمانين مادة حيث وردت أحكام عامة فى القانون وتطبيقه وفي الأشخاص وفي تقسيم الأشياء والأموال ثم ينقسم إلى قسمين أحدهما للإلتزامات بوجه عام ويختص الثاني بالعقود المسماه والقسم الآخر للحقوق العينية وهو يتضمن كتابين أيضا كتابا ثالث يعرض للحقوق العينية الأصلية وكتابا رابعا موضوعه الحقوق العينية التبعية أو التأمينات العينية.
