ترتكز حكمة مرور الزمن على اعتبارات ثلاثة هي : مقتضيات النظام العام، وعقوبة الاهمال، وقرينة براءة الذمة.
فمقتضيات النظام العام تتمثل في أن مصلحة المجتمع واستقرار التعامل تستدعيان انهاء الخصومة بين الافراد. وعقوبة الاهمال توجب على الدائن فقد رعاية القانون له اذا تقاعس عن المطالبة بحقه. اما قرينة براءة الذمة فتعني ان تأخر الدائن عن المطالبة بحقه خلال مدة معينة، يدل في كثير من الاحيان إما على استيفائه لهذا الحق، أو على تنازله عنه.
والزمن يمر، بوجه عام على كل الحقوق ما عدا بعضها الذي يستعصي على فكرة مرور الزمن، نظرا لطبيعتها الذاتية الجوهرية المرتبطة بشخص صاحبها، أو لعدم توافر الشروط اللازمة لبدء سريان مرور الزمن، كمسائل الاحوال الشخصية ، والحقوق المقيدة في السجل العقاري، وحق الملكية وحق التصرف.
غير أنه إذا كان الزمن لا يمر على بعض الحقوق، فإن الدعاوى بشأنها تخضع لأحكام مرور الزمن.
ويميز بين مرور الزمن المدني ومرور الزمن التجاري ومرور الزمن في القضايا الادارية والمالية ومرور الزمن الجزائي .
كما يميز بين مهل مرور الزمن ومهل الاسقاط ومهل المحاكمة .
