لا شك أن فكرة الاعتبار الشخصي تلعب دورًا بالغ الأهمية في مجال العقود الإدارية، وذلك نظرًا لصلة العقد الإداري الوثيقة بالمرفق العام، ومن ثم فإن الإدارة يتعين عليها أن تراعي عند إبرام العقد توافر اعتبارات معينة فيما يتعلق باختيار المتعاقد معها، وكذلك فيما يتعلق بتنفيذ العقد.
ولكن يثور التساؤل عن مفهوم فكرة الاعتبار الشخصي، وما هو نطاقها؟ هذا من ناحية، ومن ناحية أخرى هل يجوز للمتعاقد مع الإدارة أن يتنازل عن عقده أو أن يتعاقد بشأنه من الباطن على الرغم من التزامه بالتنفيذ الشخصي؟ أم أن هذا يشكل إخلالًا بفكرة الاعتبار الشخصي ومن ثم لا يجوز له ذلك؟ ومن ناحية ثالثة قد يتعرض المتعاقد مع الإدارة لظروف معينة أثناء فترة تنفيذ العقد، مثل وفاته، أو شهر إفلاسه أو إعساره. لذا ما هو أثر هذه الظروف على الرابطة العقدية بين الإدارة والمتعاقد معها؟ وبعبارة أخرى هل تستمر الرابطة العقدية قائمة على الرغم من وجود هذه الظروف؟ أم أنها تنتهي على أثر حدوث تلك الظروف؟
سوف نجيب على كل هذه التساؤلات من خلال تناولنا لموضوع فكرة الاعتبار الشخصي في مجال العقود الإدارية، متبعين في دراستنا له منهج الدراسة المقارنة بين القانونين الفرنسي والمصري، حيث نبين موقف المشرع والفقه والقضاء الإداري في كل جزئية من جزيئات البحث كلما كان ذلك ممكنًا.
وعليه سوف نقسم هذا البحث إلى أربعة فصول هي: [الفصل الأول: ماهية فكرة الاعتبار الشخصي، الفصل الثاني: التزامات المتعاقد مع الإدارة بصفة عامة، الفصل الثالث: التزام المتعاقد بالتنفيذ الشخصي للعقد الإداري، الفصل الرابع: أثر فكرة الاعتبار الشخصي في مرحلة تنفيذ العقد].
