إن بحث القانون الإنتخابي يكتسب دلالة بالغة الأهمية في حياة الدولة العصرية، ليس فقط لاعتباره إحدى الآليات الناظمة لعملية تداول السلطة، وتأمين مقتضيات استقرار الدولة والحفاظ على مكوّناتها، وتثبيت الإنتظام العام لمؤسساتها الدستورية، بل لأنه يشكّل الضمانة القانونية لتحقيق المشاركة الشعبية الفاعلة المرتكزة إلى قضية مفصليّة في فاعلية الوجود الإنساني عامة، وإلى محور أساسي في الفعل المجتمعي الإنساني، الذي ينبثق عنهما تشكُّل أي مجتمع إنساني بشكل خاص.
إنه الموضوع الحدث في الزمان والمكان، الذي دفعنا إلى تقديم تجربة إضافية عبر كتاب معرفي جامع، نأمل من خلاله أن نحقق مساهمة في عمل هادف، يسعى إلى تركيز المفاهيم والمبادىء والأسس والمعايير والآليات، التي يجب أن يُبنى عليها أي قانون إنتخابي، وبأن نزيل الإلتباسات عن بعض المسائل الجوهرية، سواء من خلال طرح الإشكاليات أو التساؤلات فيها وعليها، أو عبر المقاربة بالبحث والتحليل لمنطلقاتها ومسار تطوّرها.
فالقانون الإنتخابي موضوع إشكالي، متداول بين الخاصة والعامة، سهلة حروفه، صعبة مسالكه، متقارب في أهدافه، متباعد في تحقيق مبانيه، باختلاف تصنيفه بين الغاية والوسيلة، وعدم استدراكه بالوعي حوله وعليه، يتصدّع ملاءمته للدور الذي يؤديه ... هو يشكّل المدخل الحقيقي والممرّ الإلزامي في تأمين بناء الوحدة الوطنية، وتوسيخ ثوابت العقد الإجتماعي في الدولة، مهما تعدّدت التسميات لها والمناداة فيها، فالدولة الديمقراطية العادلة، ودولة القانون، ودولة المشاركة والحريات، ودولة الحقوق والمؤسسات، ودولة الإنسان، و ... أي دولة نريد، لا تقوم بدون الشعب.
