إذا أمعنا النظر في القانون المدني المصري، وكذلك القانون المدني الكويتي فسنجد أن أيًا منهما لم يتضمن نصًا عامًا يفيد شمول فكرة الجوهرية لمراحل العقد المختلفة منذ بدء تكوينه إلى تمام تنفيذه وانقضائه. فهما كما هو الحال في أحكام القضاء يستخدمان اصطلاحات وعبارات مختلفة عند تناولهما لفكرة الجوهرية في العقد. وعلى الرغم من ذلك وجدنا فكرة الجوهرية واضحة في ثنايا هذه النصوص القانونية المتفرقة.
وعلى ذلك تتضح أهمية بحثنا في محاولة تأصيل فكرة الجوهرية في العلاقة العقدية تجمع شتات وجزئيات تلك الفكرة المتناثرة في التشريعات وأحكام القضاء التي تتناول المراحل التي يمر بها العقد لنتأكد مما إذا كان لها مفهوم واحد أم أن لها أكثر من مفهوم. وبذلك تتضح خطة هذا البحث في تقسيمه إلى بابين: الباب الأول: دور فكرة الجوهرية في مرحلة انعقاد العقد، الباب الثاني: دور فكرة الجوهرية في مرحلة تنفيذ العقد.
