شغل موضوع حقوق الإنسان الفكر الإنساني في مساره عبر الزمن، وما من عصر إلا ووجدنا فيه الكثير من المفكرين والفلاسفة، الذين شغلتهم قضية حقوق الإنسان، لأن موضوع حقوق الإنسان منذ قديم الزمان جوهر مشكلة الإنسان في المجتمع الإنساني، بل هو الموضوع الذي يحتل الاهتمام الأكبر من جانب التنظيم الدولي العالمي الجديد بل هو المؤثر الحالي في تنظيم العلاقات الدولية بين الدول، أما من ناحية أهمية دراسة فلسفة حقوق الإنسان في إطار دراسة العلاقة بين السلطة والحرية، فهي توضح لنا الأصول التاريخية والفلسفية لحقوق الإنسان. وبيان أن حقوق الإنسان ليست وليدة الإعلان العالمي لحقوق الإنسان وليست وليدة الثورات العالمية الكبرى، بل هي قديمة قدم الإنسان نفسه.
وترتبط فلسفة حقوق الإنسان بالفلسفة السياسية ارتباطًا وثيقًا، وخير ما يدلل على ذلك أن التكوين التاريخي والفلسفي لمفهوم حقوق الإنسان، ارتبط بالتطور الذي مرت به فلسفة السياسة، وبالذات من خلال تطور الرؤى حول الصراع بين السلطة والحرية، وهو يعكس تطور العلاقة بين الدولة والفرد، وسوف نركز في دراستنا على رصد معالم مشكلة العلاقة بين السلطة والحرية، وانعكاساتها على فلسفة حقوق الإنسان في المجتمعات القديمة والحديثة وعند فلاسفة الإسلام وذلك طبقًا للخطة التالية: الفصل الأول: السلطة والحرية ومفهوم حقوق الإنسان، الفصل الثاني: الحرية وتجريد السلطة وحقوق الإنسان، الفصل الثالث: حقوق الإنسان في التاريخ الداخلي للقانون في العالم القديم، الفصل الرابع: السلطة والحرية وفلسفة حقوق الإنسان في الإسلام.
