يأتي هذا الكتاب من خبرة عملية عاشها المؤلف / المحامي محمد سلامة مسلم الدويك، في مجال القانون لفترة طويلة اشتغل خلالها بآلاف القضايا الجزائية وخاصة في قطاع ما يطلق عليه الجرائم الكبرى، فلقد دافع – كما يقول – عن أكثر من ألف متهم في مجالي القتل وهتك العرض والإغتصاب، هذا، بالإضافة للمئات من القضايا المنظورة أمام المحكمة العسكرية ومحاكم أمن الدولة، وخرج بنتيجة مؤداها: أن الجريمة مهما عظمت فهي من إنتاج وإخراج وتأليف المجتمع نفسه الذي يقف أمام المتهم لمحاكمته ... من هنا جاءت هذه الدراسة القانونية (المجرم والجريمة والعقاب) للتعريف بالمجرم والجريمة والبحث في ماهية العقوبة ومدى احترامها لحقوق الإنسان والمخاطر الناجمة عند تنفيذ العقوبة بحق المجرم.
تأتي أهمية هذه الدراسة من كونها تشكل نقداً للنصوص العقابية واعتبارها بعيدة عن الواقع ذلك أنها برأي المؤلف "نقلت نصاً بنص عن قوانين أخرى وأخذت على علاتها دون تدقيق أو تمحيص وقد يكون هذا الإستنتاج الأخير أقرب إلى الواقع" وفي هذا الإطار يسلط المؤلف الضوء على وضع السجين وحالته النفسية، وسلبه أبسط حقوقه في السجن وفي الحياة، ويوضح بأنه يمكن إصلاحه بمجرد تعلُم مهنة أو عمل بأجر "فهذا المتهم ومهما حاول البعض تسمية مكان احتجازه يبقى كتلة معطلة ومغيبة عن مجتمعه ... وقد جندت الحكومات جيشاً من المختصين لتنفيذ برامجها لعقاب المجرم من الشرطة والإدعاء العام والمحاكم والسلطات ومن ثمّ إدارة للسجون ... وغيرها من مستلزمات الإصلاح".
ولمزيد من الإيضاح وزع المؤلف دراسته على ستة عشر باباً تناول فيها علم الإجرام والجرائم بأنواعها والسياسات العقابية مقارنة ببعض الأنظمة العقابية العربية والدولية، والآثار المترتبة على العقوبة، ومشكلة الحق العام، وأخيراً: الحلول والإقتراحات الواجب اتباعها والسير على هديها.
