Book Description
التلمود: شريعة بنى إسرائيل الشفهية، ويطلق عليه اسم الشريعة الشفهية لعدة أسباب: أولاً: لتمييزه عن أسفار العهد القديم التي يطلق عليها اسم الشريعة المكتوبة. ثانياً: لأنهم كانوا يتعلمونه ويعلمونه مشافهة. ثالثاً: لأنهم نهوا عن تدوينه استناداً إلي ما جاء في تفسير سفر الخروج (مدراش شموت رابا 11/47): "أمر القدوس تبارك موسى قائلاً: دون أسفار التوارة والأنبياء والمكتوبات أما التفاسير والمرويات والتلمود فتكون شفاهة".
يتكون التلمود من متن. عبارة عن تشريعات وتسمى (مشناً) وضعها عدة أجيال من العلماء يسمون (تنائيم)، وشروح علي هذا المتن وتسى (جمارا) وضعها في مرحلة لاحقة أجيال أخرى من العلماء يسمون (أمورائيم).
ونص المشنا أو متن التلمود ليس نصاً واحداً. وإنما تجميع اجتهادات علماء اليهود وتشريعاتهم علي مدى سبعة قرون (من الخامس ق.م إلي مستهل الثالث الميلادي)، وقد خضعت تلك النصوص في جمعها لعملية (غربلة) علي عدة مراحل، آخرها التي قام بها الربى يهوداً هناسى في مستهل القرن الثالث الميلادي عند تبويب نص المشنا، فقد استبعد مجموعة كبيرة من التشريعات والنصوص لاعتبارات خاصة به، وبناء علي مستجدات ومستحدثات عصره والظروف الخارجية آنذاك، وأطلق عليها أسم "برايتا" وتعنى "برانية" أو خارجية، فيهودا هناسى لم يضع تشريعات المشنا ولم يؤلفها فهى ليست عملاً فردياً. واقتصر دوره علي تبويب وترتيب تشريعات المشنا في صورتها الحالية الموجودة بين أيدينا وتنقيحها. وعلي الرغم من أن يهودا هناسى قد استبعد ال "البرايتا" ولم يضمها إلي كتاب المشنا، فإنها عادت إلي الظهور علي صفحات التلمود في سياق نقاش العلماء لنص المشنا.
