إن مسألة منع المدين من السفر هامة لانها تشكل مساسا بحريته الشخصية المكفولة وفقا للمادة 30 من الدستور الكويتى وبحريته فى التنقل التى تكلفها المادة 31 من الدستور الكويتى والتى تعتبر جزءا من الحرية الشخصية لذلك وفقا لرأى العالم الجليل الأستاذ الدكتور فتحى والى يجب النظر الى هذا المنع باعتباره نظاما استثنائيا فلا يجوز التوسع فى تفسير النص التشريعى الذى يسمح به.
غن المشرع الكويتى أخذ على خلاف كثير من التشريعات الحديثة بالاكراه البدنى كمبدأ قهر المدين على تنفيذ إلتزامه المالى- ايا كان نوعه أو طبيعته أو مصدره- بوسيلتين الاولى "وقائية" وهى منع المدين من السفر (وهو موضوع بحثنا) والثانية علاجية وهى "حبس المدين" وعلى الرغم من أن لكل منهما مجاله وشروطه وأحكامه التى تختلف عن الآخر الا أن احكام القضاء الكويتى وراء الفقه تضاربت فى هذا الشأن.
ومحاولة منا فى تأصيل نظام منع المدين من السفر فى قانون المرافعات الكويتى سنتطرق فى خطة البحث الى مفهومه (فصل أول) محددين ما هيته (مبحث أول) من خلال بيان اساسه الشرعى (مطلب أول) وتعريفه وطبيعته (مطلب ثالث( ثم بيان شروطه (مبحث ثالث( وبعد ذلك نوضح نظامه القانونى الاجرائى (فصل ثان) من خلال معرفة اجراءات الطلب والفصل فيه وآثاره (مبحث أول) وقواعد واجراءات الطعن فى القرار الصادر بالمنع وتنفيذه (مبحث ثان) ثم اخيرا نتناول حالات الغاء الامر بالمنع من السفر (فصل ثالث) سواء أكانت أسباب الالغاء عامة (مبحث أول خاصة (مبحث ثان).
