غاية كل تنفيذ- وبصفة خاصة الجبري- هي حصول الدائن على حقه للانتفاع بثماره ومنافعه من المدين أو الملتزم بالسند التنفيذي، فإذا كان مضمون حق الدائن الوارد في السند التنفيذي هو مبلغ من النقود- الذي في نفس الوقت هو محل التزام المدين- فإن التنفيذ يتم عن طريق الحجز على أموال المدين وبيعها. واستيفاء الدائن لحقه من النقود التي يتم الحجز عليها أو المتحصلة من بيع الأموال محل التنفيذ أى من حصيلة التنفيذ. لكن هذا الاستيفاء لا يثير مشاكل إجرائية إلا إذا تعدد الدائنون ذوو الحق في الاستيفاء وكانت حصيلة التنفيذ غير كافية للوفاء بكامل حقوقهم ومن أجل هذا يتدخل عادة المشرع لوضع قواعد وإجراءات لتوزيع هذه الحصيلة على هؤلاء الدائنين وإن كان في الوقت نفسه قد ترك لمن لهم حق الإشتراك في التوزيع قدراً من الحرية في هذا الشأن بأن سمح لهم بالإتفاق بينهم ودياً على طريقة التوزيع ولكن تحت إشراف قاضي التنفيذ.
