فبعدها قد تغير مركز الجاني لمجرد متهم قد لا يعاقب وتغير مركز المجني عليه فلم يقتل بل عاش ولم يصبح مجني عليه إذا الجريمة المستحيلة نقطة تحول هامة في مصير الجاني والمجني عليه فيجب عند دراسة الجريمة المستحيلة أن نتناول بالدراسة الشروع في الجريمة بإعتباره المحتوي ، والذي يضم الجريمة المستحيلة بين طياته.
