تتمحور الفرضية الرئيسية لهذا الكتاب حول: أن سقوط نظم الحكم في العالم الثالث يرتبط بحالة التلوث القانوني، حيث تصبح مهمة القانون خدمة مصالح التزاوج بين السلطة والمال، وبموجب القانون يصبح المواطن مستبعداً سياسياً واجتماعياً واقتصادياً، ولقد تعرض المؤلف لمجموعة من الدراسات التي أجريت على مجموعه من القوانين التي صدرت في الفترة من 1981 حتى 2010 في مصر، وتعطي هذه الدراسات نموذجاً لسقوط الدولة في مجتمعات العالم الثالث، من خلال اختبار نموذج استخدام القانون في حماية مصالح النظام الحاكم، سواء كانت المصالح اقتصادية أو سياسية، تتمثل في الاستبعاد السياسي والاجتماعي لباقي الفئات والطبقات، وحينما تتهدد مصالح النظام يسعى إلى استخدام القانون وتجريم الأفعال الفردية والجماعية، والتضييق على المجتمع كله، مما يضعف شرعية النظام بل وربما يفقده هذه الشرعية بكاملها، عندئذ يسقط النظام وتسقط دولته، لتبدأ مرحلة جديدة من مراحل نشوء الدولة وصعودها.
