لاريب أن تاريخ الإسلام من أهم التواريخ العامة؛ لأنه يتضمن تاريخ العالم المتمدن في العصور الوسطى، أو هو حلقة تصل ما بين التاريخ القديم والتاريخ الحديث: فيه ينتهي التمدن القديم، ومنه تشرق الحضارة الحديثة، غير أن النظر في هذا الأمر على هذه الصورة لا يكون واضحاً وافياً إلا إذا تقدمه البحث عن حال تلك الأمة الإسلامية في بداوتها قبل ظهور الإسلام وبعده، وكيف تدرجت إلى الحضارة، وما هي العوامل التي عاونتها في ذلك، ولا شك أن البحث عن أحكام القانون الدولي في الشريعة الإسلامية يتصل بالبحث السابق ويرتبط به ارتباطاً حتمياً. وهو بحث يثير التهيب في النفس لما له من أهمية وخطر، ولما يحيط به من المشاعر والأحاسيس الدقيقة والمرهفة، ولما يتطلبه في الباحث من استقلال في الفكر والرأي، والبحث في أحكام القانون الدولي في الإسلام يستلزم بحكم المنطق - أن تعقد المقارنة بين القانون الدولي المعاصر وبين الشريعة الإسلامية في خصوص المبادئ والأحكام التي يتضمنها هذان النظامان القانونيان لضبط العلاقات التي تقوم بين الجماعات الإنسانية التي يطلق عليها في الإصطلاح وصف الدول. وعقد مثل هذه المقارنة على أساس صحيح يجب أن يستند إلى المعايير الموضوعية السليمة التي لا يكدر صفوها الميل، أو المشاعر العاطفية. أو الأحاسيس الدينية المرهفة، وذلك إذا ما كان عقد مثل هذه المقارنة يستهدف الكشف عن الحقيقة الخالصة، بوصف أنها هي وحدها التي تحرر النفوس وتهديها إلى الصراط المستقيم.
